(a) Notwithstanding Article 9 (commencing with Section 11120) of Chapter 1 of Part 1 of Division 3, any action taken by the commission prior to the effective date of this section is not subject to an action under Section 11130.3. For purposes of Section 11130.3, any such action shall be deemed to have been taken in substantial compliance with Sections 11123 and 11125.

(b) No member of the commission shall be found to have violated any provision of Article 9 (commencing with Section 11120) of Chapter 1 of Part 1 of Division 3 for any action taken prior to the effective date of this section.
